Terms of Service and End User License Agreement

These terms govern your use of ScreenGuardian, the official ScreenGuardian website, and related services. They serve as both our Terms of Service (covering your account, the website, downloads, support, and access) and the End User License Agreement (EULA) for the installed desktop app. By downloading, installing, or using ScreenGuardian, you agree to these terms.
1. Early access
ScreenGuardian is currently offered through gated early access. Access is free while early access is active on your account. We may revoke early access or an explicit access grant at our discretion, including for abuse, expired invite waves, unauthorized redistribution, or security reasons.
During gated early access, downloading and using the full desktop app requires an account with active early access, an explicit access grant, or paid access. If a limited free or trial mode is offered, it is subject to the limits shown in the app or on the website.
Early-access releases may change. Local data formats, settings, and history may not survive between versions, and features may be added, removed, or reshaped at short notice. Don't rely on early-access data persistence for anything important.
2. License
ScreenGuardian is licensed, not sold. We grant you a personal, non-exclusive, non-transferable, revocable license to install and run ScreenGuardian on computers you own or control for your own use. No ownership of the software or any intellectual property in it transfers to you; we and our licensors retain all rights not expressly granted.
You may not:
- Redistribute, resell, sublicense, rent, lease, lend, or bundle ScreenGuardian in another product without prior written permission.
- Reverse-engineer, decompile, disassemble, or modify ScreenGuardian except where applicable law allows.
- Remove or alter trademarks, copyright notices, or signing material.
- Circumvent, disable, or interfere with any technical measure that protects ScreenGuardian, including entitlement and access checks, device-limit enforcement, update signature verification, the desktop device-link, or the protected-download flow — or use any tool, automation, or modified build to obtain access you are not entitled to.
3. Invites and acceptable use
Invites are for personal, good-faith use by the intended recipient. Publishing, selling, sharing, or attempting to bypass access, download controls, desktop app linking, update signing, or account access checks may terminate your access.
You may not redistribute installers, mirror download URLs, automate mass redemptions, or use ScreenGuardian in a way that interferes with ScreenGuardian or other users.
4. Paid plans
ScreenGuardian is free while early access is active on your account. When paid plans launch, continued use will require an active plan or explicit access grant. Pricing, renewal, cancellation, refund, and trial details will be shown clearly before checkout. Payment details will be handled by a secure checkout provider. We will not store your full card number.
If subscriptions are offered, you will be able to manage or cancel your plan from your account or through instructions shown at checkout. Any auto-renewal terms will be disclosed before you subscribe.
5. Support reports and crash reports
If you choose to send feedback, a support report, attachments, screenshots, or logs, you are responsible for making sure you are comfortable sharing that content. ScreenGuardian may use those materials to investigate bugs, reliability issues, account issues, and support requests.
Optional crash reports are off unless you turn them on in the app. If enabled, they are limited to technical failure details and do not include camera frames, screenshots, posture history, habit history, microphone audio, typed content, or raw local files.
6. Device security and pre-existing compromise
ScreenGuardian is not antivirus, endpoint protection, or a malware-removal tool. You are responsible for keeping your operating system, browser, security tools, drivers, and other software reasonably up to date, and for avoiding malware, unsafe downloads, and unauthorized access to your device.
We design ScreenGuardian to reduce avoidable security risk in the app, website, downloads, and update flow. However, we are not responsible for damage caused by malware, tampering, compromised accounts, vulnerable system software, malicious third-party software, or other pre-existing problems on your device or network that are not caused by ScreenGuardian.
6.1 Consent to local face-geometry processing
ScreenGuardian's core features rely on detecting face, pose, and hand landmarks from your webcam — measurements that some jurisdictions classify as "biometric identifiers" or "face geometry." By installing and using ScreenGuardian you give your explicit, informed consent to that processing as described in the Privacy Policy:
- The processing is on-device only.
- Landmark data is held in memory for milliseconds and then discarded.
- Nothing about your face, body, or pose is written to disk, sent to us, or sent to any third party.
- ScreenGuardian does not use this data to identify you and does not build any persistent biometric template.
You may withdraw consent at any time by uninstalling the app; because no biometric data is stored, there is nothing further to delete on our side. This clause is designed with the consent expectations of the Illinois Biometric Information Privacy Act (BIPA) and the explicit- consent provision of EU GDPR Article 9 (special category data) in mind. Whether and how those laws apply to on-device, zero-retention landmark processing is ultimately a legal question, and this section should be reviewed by counsel before being relied on as a defence in any specific jurisdiction.
7. Wellness disclaimer
ScreenGuardian is a wellness aid, not a medical device. It is not intended to diagnose, treat, prevent, or cure any medical condition, and it is not a substitute for medical, ergonomic, or occupational-health advice. If you have a medical concern, consult a qualified professional.
We do not guarantee that posture, distance, break, or habit reminders will be perfectly accurate for every person, room, camera, or desk setup.
8. Disclaimer of warranties
ScreenGuardian is provided "as is" without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or compatible with every device or environment.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from your use of ScreenGuardian.
Our total liability is limited to the greater of the amount you paid for ScreenGuardian in the 12 months before the claim or $50.
Some jurisdictions do not allow these limitations, so they apply only to the fullest extent permitted by local law.
10. Termination
You may stop using ScreenGuardian at any time by uninstalling it. We may suspend or terminate access if you violate these terms.
11. Changes
For material changes to these terms, we will give notice by email to the address on your account and post a notice on the website before the change takes effect, so you have a chance to review it. Minor edits (clarifications, typo fixes) update the "Last updated" date only. Continued use after changes take effect constitutes acceptance.
12. Governing law
These terms are governed by the laws of the United States and the State of Nevada, without regard to conflict-of-law rules. If that conflicts with a mandatory consumer-protection law in your country or state, the local mandatory law wins.
13. Trademarks and copyright
"ScreenGuardian" and the ScreenGuardian logo are unregistered trademarks of Eric W. The source code, binaries, designs, copy, and documentation that make up the ScreenGuardian product are copyrighted works of Eric W, © 2026. The desktop app bundles third-party open-source components governed by their own licenses; attributions are listed at https://screenguardianapp.com/licenses and inside the desktop app under About → Third-party notices.
